Terms & Conditions

Agreement to these terms

These Terms & Conditions (“Terms”) govern your use of nexttakemedia.com and its pages (the “Site”), operated by Next Take Media (“Next Take Media,” “we,” “us,” or “our”). By using the Site or booking a call, you agree to these Terms. If you do not agree, please do not use the Site.

Our services

Next Take Media scripts, films, edits and produces video ad creatives for businesses. The Site describes our services and lets you book a call with our team. Any engagement to provide services is governed by a separate written agreement or proposal between you and Next Take Media, which sets out the scope, deliverables, timeline, price, payment, cancellation and refund terms. If that agreement conflicts with these Terms, the agreement controls.

Booking a call

When you book a call, you agree to give accurate information. A call is a conversation to understand your business and see whether we are a fit; it does not create a client relationship or an obligation for either party to buy or provide services. We may decline, reschedule or cancel a call at our discretion. Please reschedule using the link in your confirmation if you cannot attend.

No guarantee of results

Information on the Site, including case studies, view counts and examples, describes past experiences and is provided for general information only. It is not a promise or guarantee of future results. Next Take Media does not guarantee specific views, followers, leads, sales, income or ad performance. Results depend on each business, its offer, its market, its ad spend and its execution.

Communications

By booking a call, you agree that we may contact you by email and phone about your call and our services. If you separately agree to receive text messages, we may send messages about your booked call, such as confirmations and reminders. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. Consent to text messages is not a condition of any purchase. Our Privacy Policy explains how we handle your information.

Intellectual property

The Site and its content, including text, videos, graphics and the Next Take Media name, belong to Next Take Media or its licensors and are protected by law. You may view the Site for your own personal or internal business use. You may not copy, reproduce, distribute or create works from its content without our written permission. Ownership and usage rights for creatives we produce for clients are set out in the client agreement.

Acceptable use

You agree not to misuse the Site, including by submitting false information, interfering with its operation or security, attempting to access systems or data you are not authorized to access, or using it for any unlawful purpose.

Third-party services

The Site uses third-party tools, such as our booking calendar, and may link to other websites. We are not responsible for third-party services or websites, and your use of them is subject to their own terms and policies.

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, Next Take Media and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business opportunities, arising from or related to your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred US dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

Indemnification

You agree to indemnify and hold harmless Next Take Media from any claims, losses and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or your violation of these Terms.

Governing law
